General Terms and Conditions for Consumers (as of November 2024)
1. Scope
These General Terms and Conditions (GTC) apply to all deliveries from WESTHYPE® (registered trademark of Invesita eU) to consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither related to their commercial nor their independent professional activity .
2. Contracting parties
The purchase agreement is concluded with Invesita eU, Mariahilfer Straße 1, 8020 Graz, Austria.
2.1 Contract language
The contract language is German and English.
2.2 Conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer, but merely an invitation to the customer to submit an offer. The customer's order constitutes an offer. Once we receive the order, the customer will be notified of its receipt via the email address they provided. This notification does not yet constitute acceptance of the customer's offer on our part. A contract is only formed upon our acceptance. Acceptance occurs with the shipment of the ordered goods. Our confirmation of receipt of the customer's order via email does not constitute acceptance of the offer on our part.
2.3 Right of withdrawal
You have the right to withdraw from this contract within 30 days without giving any reason.
The cancellation period is 30 days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.
Return policy:
To exercise your right of withdrawal, you have several options:
a.) Via your customer account
- Log in to your account:
- Enter your email address in the **Email** field and then click **Next**.
- Open the email sent by our shop in your email account and copy the
- six-digit confirmation code in the email.
- Go back to the online shop and enter the six-digit confirmation code.
- If your order includes more than one item, select the items you wish to return.
- Click on the order for which you are requesting a return.
- Select a reason for return and add a note for the shop.
- Click on **Request a Return**. If your return request is approved and shipping is required, you will receive an email with shipping instructions and a return label.
- If the product is returned undamaged, you will receive your refund.
b.) via e-mail
You can also inform us of your cancellation by email. Please send us the order number for the cancellation to the following email address: office@westhype.com. After successful verification, a return label will be sent to your email address. Print this return label, affix it to the package, and drop it off at the parcel service provider specified on the return label.
To meet the cancellation deadline, it is sufficient that you send your notification of exercising your right of cancellation before the cancellation period expires.
2.3.1 Consequences of revocation (withdrawal)
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (excluding any additional costs incurred if you chose a delivery method other than our cheapest standard delivery option), without undue delay and no later than fourteen days from the day on which we received your notification of withdrawal. You must return the goods to us without undue delay and in any event no later than 30 days from the day on which you notify us of your withdrawal from this contract.

2.3.2 When does the right of withdrawal (right of cancellation) expire?
The right of withdrawal (right of cancellation) is forfeited in the event of any loss in value of the goods if this loss in value is due to handling of the goods beyond what is necessary to ascertain their nature, characteristics, and functioning. The right of withdrawal (right of cancellation) is also forfeited for products delivered in sealed packaging if the seal has been broken after delivery.
3. Prices and shipping costs
All prices are total prices. They include all taxes, including VAT, unless otherwise stated. Shipping costs will be clearly displayed in your shopping cart during checkout.
4. Destination country
The online shop is geared towards Austria, Belgium, Bulgaria, Greece, Croatia, Liechtenstein, Malta, Monaco, Luxembourg, the Netherlands, Poland, Portugal, Romania, Sweden, Slovenia, Serbia, Slovakia, San Marino, the Czech Republic, Denmark, Hungary, Italy, France, and Germany. We deliver exclusively to addresses in these countries.
5. Payment
Payment can be made via PayPal, EPS, Maestro, Visa, Mastercard, Klarna, Google Pay, Apple Pay, or bank transfer. If you choose bank transfer, we will provide our bank details in the order confirmation.
6. Retention of title
The goods remain our property until full payment is received.
7. Dispute Resolution
The European Commission has established an online platform for dispute resolution. This platform serves as a point of contact for the out-of-court settlement of disputes concerning contractual obligations arising from online sales contracts. Further information is available at the following link: http://ec.europa.eu/consumers/odr. We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.
